WB Soul ეკოსისტემის პირობები

By registering WB Soul (hereinafter – the “Service”) you agree to unconditionally accept and comply with the WB Soul Terms stated below (hereinafter – the “Agreement”). You should read the entire Agreement carefully before accessing and using the Service. If you do not accept this Agreement, you shall refrain from using the Service.

By accessing and using the Service you agree that you have read, understand and accept this Agreement, WhiteBIT User Agreement, and all other operating rules, policies, and procedures referenced herein, each of which is published on the Website and each of which may be updated from time to time. You may not use the Service if you do not unconditionally accept this Agreement.

The Service is managed by Clear White Solutions Limited (BVI) (hereinafter – “We”, “Us”, “Our”).

Definitions

In addition to the other terms defined elsewhere in this Agreement, the following terms shall have the meanings ascribed to them below:
Account - according to the definition stipulated in the WhiteBIT User Agreement.
KYC - Know Your Customer, procedure of the User verification process performed by WhiteBIT.
SBT - Soulbound token, unique and inseparable from the WB Soul token, storing information, and received on the basis of smart contract.
Third Party - any person or legal entity which is beyond Our control. Whereby person or legal entity is regarded as having control if it owns or controls, directly or indirectly, fifty percent (50%) or more of the shares entitled to vote for the election of directors, management authority, or other persons performing similar functions or possesses other ability, directly or indirectly, to direct or cause the direction of the management or policies of such entity.
User - means any person, who uses the Services, is a holder of the Account and has entered the WhiteBIT User Agreement.
WBT - WhiteBIT Coin, the native coin of WhiteBIT exchange.
WB Network - WhiteBIT Network Blockchain.
WB Soul - means unique identifier in the WB Network, inseparable and connected to the Account, allowing to receive the SBT.
WhiteBIT User Agreement - means WhiteBIT Platform’s public electronic User Agreement posted at https://whitebit.ge/terms.
WhiteBIT - according to the definition of “WhiteBIT Group” as stipulated in the WhiteBIT User Agreement.

The headings are for convenience only and shall not affect the meaning or interpretation of this Agreement.

Unless the context otherwise requires, words in the singular shall include the plural, and in the plural shall include the singular; a reference to one gender shall include (shall imply) a reference to the other genders.

Subject of the Service

We provide Users, who have completed KYC verification with WhiteBIT, with the option to register the WB Soul within the WB Network. You understand and agree that by registering the WB Soul you provide Us with explicit consent to create a unique identifier within WB Network corresponding to the WB Soul.

The WB Soul cannot be transferred and is inseparable from Account.

The WB Soul functionality and features connected to the WB Soul may be limited due to KYC invalidity or expiration.

The gas fee may be applied for the WB Soul registration. Gas fee may change from time to time and it's the User’s sole obligation to verify the current fee prior to the WB Soul registration. Gas fee is not subject to return or reimbursement.

SBT, Soulbound Tokens

The WB Soul may be attributed to the SBT, a non-fungible token that is issued within the WB Network.

Issuance of the SBT and use of your WB Soul as the identifier for the issue of SBT are subject to the terms and conditions of a Third Party which is responsible for such SBT issue and attribution unless such SBT is issued by Us.

Soul Attributes and Publicity

The WB Soul may display different attributes attached to it (“Soul Attributes”), as well as details of the Account which has registered the WB Soul. The list of the Soul Attributes is not fixed and may change from time to time.

By registering the WB Soul, the User irrevocably agrees to make publicly available within WB Network the following information about the Account which has registered the WB Soul:

• the User Account KYC verification status (verified/not verified);
• the User Account amount of WBT on WhiteBIT Holding;
• other Account details which may be deemed as Soul Attributes, taking into account that neither any of them nor all of them as a group constitute Personal Data.

The above-mentioned information will be publicly available to all visitors of the WB Network. It is the User’s responsibility to secure the anonymity of the connection between the Account and the WB Soul.

The User can disable the public display of their WBT on WhiteBIT Holding through the WB Soul management page switching the “Hide Hold” parameter.

We reserve the right to attach labels to the WB Soul at any time if, at our sole discretion, We find the activity related to the WB Soul suspicious or fraudulent.

Irreversibility

WB Soul registration is irreversible. WB Souls which were registered cannot be removed from the WB Network, as well as attributed to the WB Soul SBT.

You understand and agree that by registering the WB Soul you will not be provided with the option to revoke, destroy, or in any other way liquidate the WB Soul or attributed SBT. Removing, canceling, and deleting the Account should not lead to the WB Soul removal.

You understand and agree that WB Souls created on the WB Network Testnet will be transferred to the WB Network Mainnet. The SBT attributed to the WB Soul in WB Network Testnet may be transferred automatically to the WB Network Mainnet, lost, or become subject to reissue, depending on each particular SBT. Liability Limitation

To the maximum extent permitted under the applicable law, the Service is provided on an “as is” and “as available” basis. We expressly disclaim, and the User waives Service fitness for a particular purpose or non-infringement, any and all other warranties of any kind. Without limiting the foregoing, We do not represent or warrant that the Service or materials are accurate, complete, reliable, up-to-date, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by the applicable law, in no event will Our affiliates, Our and Our affiliates' shareholders, owners, members, directors, officers, employees, attorneys, agents, representatives, suppliers, or contractors be liable for any incidental, indirect, consequential or similar damages or liabilities whatsoever (including, without limitation, damages for loss of data, information, revenue, profits or other benefits) arising out of or in connection with the Service, any performance or nonperformance of the Service, or any other product or other item provided by Us or on Our behalf.

The User understands that third parties, which are beyond Our control, may decide to use WB Soul as the identifier for their own purposes at their sole discretion. The User agrees that We are not responsible for the actions of such third parties, and the consequences of their use of WB Soul.

Modification

The User acknowledges and agrees that WhiteBIT shall have sole discretion and absolute control over, and the right to modify at any time, the Service, as well as the exclusive right to make any changes to their functionality, configuration, appearance, and content.

We are entitled to unilaterally amend the terms and conditions of this Agreement. Such amendments take effect upon the expiry of three (3) days from the date of posting a new version of the Agreement.

With each subsequent use of the Service, the User shall familiarize himself/herself with a new version of the Agreement. Continued use of the Service, will mean the User’s acceptance of the terms and conditions of a new version of the Agreement.
